Protect Your Ministry’s Mission with a
Strong Legal Foundation

Your governing documents could be your first line of defense in a challenge to your religious liberty. Ensure they reflect your faith and mission with the Religious Liberty Assessment.

Ensure your bylaws & policies support your mission, not weaken it

Operating a church or ministry today means facing growing cultural and legal challenges. Many leaders don’t realize that outdated or incomplete governing documents could leave their ministry vulnerable.

The Religious Liberty Assessment is here to help
Designed specifically for churches and ministries, this tool helps identify potential vulnerabilities in your foundational documents and provides actionable steps to strengthen them. It’s not just about avoiding legal pitfalls—it’s about ensuring your ministry is prepared to confidently live out its calling.

Ensure Your Bylaws & Policies Support Your Mission, Not Weaken It

Operating a church or ministry today means navigating growing cultural and legal challenges. Many church and ministry leaders don’t realize that outdated or incomplete documents and policies could leave their ministries vulnerable to legal scrutiny — and compromise the religious liberty protections they rely on to live out their missions.

The Religious Liberty Assessment is designed to help. An ADF attorney will review your governing documents and policies to identify any gaps that could weaken your religious liberty protections and provide actionable steps to strengthen them. It’s not just about avoiding legal pitfalls—it’s about ensuring your ministry is equipped to confidently live out its calling.

  • In Oregon, a pro-life organization was denied a religious exemption from covering abortifacients in its healthcare plan in part because its policies and documents failed to clearly reflect a religious mission and identity.
  • In Wisconsin, a Catholic charitable organization was forced to join a state unemployment program because the state questioned whether its outreach efforts were truly religious.

Even the U.S. Supreme Court examines the governing documents of ministries to evaluate their religious identity. In a recent case, Justice Alito reviewed a Christian college’s bylaws to see how its faith was integrated into its operations and mission. The college’s ability to maintain religious protections depended heavily on the clarity and consistency of its governing documents.

Are Your Governing Documents Strong Enough To Protect Your Ministry’s Mission?

Ready to find out? Here's how the Religious Liberty Assement Works

The Religious Liberty Assessment is a members-only tool that provides your church or ministry with an initial review of its foundational documents—such as its Bylaws, Articles of Incorporation, Constitution, Statement of Faith, and additional doctrinal statements. This review helps identify potential legal vulnerabilities that could impact your religious freedom. By clarifying where your ministry’s policies align with its biblical mission, the assessment establishes a baseline for safeguarding its religious identity.

Start Building Solid Legal Footing in 3 Simple Steps:

Join the Church & Ministry Alliance Program

Become a member and gain access to the Religious Liberty Assessment and other valuable benefits to support your ministry.

2

Complete the Religious Liberty Assessment and Submit Your Documents

Fill out the online questionnaire to provide us with insights into your church or ministry’s legal circumstances. Upload the necessary documents (bylaws, articles of incorporation, constitution, statement of faith, and additional doctrinal statements) to help us assess the legal foundations for your religious liberty.

3

Receive Legal Review and Consultation

An attorney will review your submission and documents, provide you with personalized feedback, and schedule a meeting to discuss the results and next steps for building the legal foundation for your ministry’s religious liberty. Based on this initial review of your foundational documents, we will recommend additional reviews of other key areas, such as facility use policies or employment practices.

Three Reasons Churches and Ministries Overlook Their Governing Documents

"Are documents really that important?”

Your ministry’s heart is its people and mission. But your documents and policies are the framework that supports it. They’re not just a legal necessity; they’re a way to articulate who God has called your ministry to be.

Working with the Church & Ministry Alliance means your documents and policies will be reviewed by attorneys who understand the unique challenges ministries face.

2

"We don’t have time for that.”

With sermons to prepare and people to serve, reviewing your documents and policies often gets put on the back burner. But reviewing your documents isn’t just a legal task—it's a spiritual opportunity. They reflect the core of your ministry’s calling and identity. Waiting until “someday” often means waiting until it’s too late.

The Religious Liberty Assessment simplifies the process into manageable steps, so your ministry is protected without unnecessary stress.

3

“Our documents seem fine.”

It’s easy to assume that bylaws written years ago are still sufficient. But outdated documents can fail to reflect your ministry’s unique calling or provide the clarity needed to withstand today’s challenges.

Common Questions and Answers

What is the Religious Liberty Assessment?

The RLA is a tool designed specifically for churches and ministries to evaluate the legal foundation for their religious liberty and identify potential vulnerabilities. It provides personalized recommendations to strengthen your governing documents, helping you align them with your mission and values.

How do I get started?

Joining the Church & Ministry Alliance is your first step. Once you’re a member, you can access the Religious Liberty Assessment and start strengthening your ministry’s foundation.

Do I need to be a CMA member?

Yes, the RLA is an exclusive benefit of Church & Ministry Alliance membership, which also includes access to experienced attorneys, resources, and ongoing support to help safeguard your ministry’s mission.

What is included in CMA membership?

Membership includes the Religious Liberty Assessment, legal support, educational resources, advocacy opportunities, and access to a community of like-minded leaders.

How does membership benefit my ministry long-term?

Membership ensures ongoing access to resources, attorneys, and updates to help your ministry adapt to cultural and legal challenges over time.

What documents do you review?

We start by reviewing four key governing documents: your bylaws, articles of incorporation, statement of faith, constitution, and additional doctrinal statements. As part of the process, we also inventory your ministry’s other policies to identify areas where future reviews may be needed.

If I haven't completed the Religious Liberty Assessment, can I still submit a different document for review based on urgency/need?

We recommend starting with the Religious Liberty Assessment, but you may also have documents that need to be reviewed on an individual basis, and we’re here to help. You may submit other documents related to your organization’s religious liberty, and an ADF attorney will review them.

Is there a limit to how many documents I can submit for review?

The RLA starts with four core documents, but additional reviews and tailored guidance are available as part of your membership.

What happens after the RLA?

The RLA is just the beginning. After reviewing your documents, our attorneys will provide tailored recommendations to address any gaps and guide you on next steps to strengthen your ministry’s legal foundation.

How long does it take?

From submission to consultation, the process typically takes 4–5 weeks. Timelines may vary depending on the complexity of your documents and the volume of requests.

What if we’ve never updated our documents?

No problem. Many ministries haven’t revisited their governing documents in years. The RLA provides a starting point to assess their current state, make necessary updates, and build a framework that serves your ministry well into the future.

Will this work for ministries of all sizes?

Absolutely. Whether you’re a small church or a large ministry, the RLA is designed to adapt to your specific needs, ensuring your governing documents reflect your mission and provide a clear legal foundation for your religious liberty.

Why can’t I just use a template for my documents?

While templates can be helpful, they often lack the nuance required to reflect your ministry’s unique mission and calling. The RLA goes beyond generic solutions by providing personalized recommendations tailored to your ministry’s needs and challenges.
